These terms apply to client engagements with WorkGaming SRL. They are deliberately short. The detailed scope of any specific engagement lives in the written proposal we send you before any payment.
Project-based, scoped per project. Every engagement starts with a written proposal that includes timeline, deliverables, payment milestones, and any assumptions. You sign or accept the proposal in writing before we start.
Most engagements use a 50% upfront / 50% on delivery split, unless the proposal says otherwise. Payments via Upwork (when sourced through Upwork) or direct invoice from the SRL.
You own the deliverables once paid in full. We retain the right to reference the engagement publicly (anonymized if you prefer) once it's complete, unless an NDA says otherwise.
Anything you tell us during scoping or engagement is confidential. We sign mutual NDAs on request, no charge.
We warrant that the work will materially match the written proposal. We don't warrant that the software will be bug-free, that it will scale beyond the agreed load, or that it will integrate with systems not listed in the proposal. Bug fixes for issues introduced by us within 30 days of delivery are free.
Our liability is capped at the total fees paid for the specific engagement. We are not liable for indirect, consequential, or punitive damages — including lost profits or data — except where Romanian law forbids that limit.
Either party may terminate an engagement in writing. You pay for work delivered up to the termination date plus any non-cancellable third-party costs we incurred on your behalf. We hand over all completed work in a usable form.
Romanian law governs. Disputes are heard in the courts of Iași, Romania. We will always try to resolve disputes by conversation first.
We will update the "Last updated" date at the top whenever this changes. Changes apply to new engagements only — terms in effect when you signed your proposal continue to govern that engagement.
